Medical Disclaimer
TENTAVA is a general fitness and wellness service. It is not a medical device, healthcare provider, clinical decision-support system or emergency service. Do not use TENTAVA to diagnose, prevent, monitor, predict, prognose, treat or alleviate a disease, injury or medical condition, or to make an urgent medical decision.
1. Scope and relationship to other terms
This Medical Disclaimer (the “Disclaimer”) applies to the Tentava mobile application, website and related features, content and services (together, “TENTAVA”) provided by KITAV Vuong (“KITAV”, “we”, “us” or “our”). It supplements the TENTAVA Terms of Use and End-User Licence Agreement, Subscription Terms and Privacy Policy.
By using TENTAVA, you acknowledge the safety information and limitations stated here. If this Disclaimer conflicts with the Terms of Use, the Terms of Use govern the contractual issue; this Disclaimer provides additional health and safety information. Mandatory law always prevails.
2. General wellness and fitness purpose only
TENTAVA is intended to help users record, plan, review and share fitness activities, training goals and general wellness information. It may present exercise content, workout plans, statistics, trends, estimates, visualisations, reminders and general training suggestions.
TENTAVA is not intended or offered for a medical purpose. KITAV does not represent that TENTAVA has been cleared, approved, certified or registered as a medical device by Swissmedic, an EU/EEA conformity-assessment authority, the United States Food and Drug Administration or another health authority.
3. No medical advice or professional relationship
Information available through TENTAVA is general information, not medical, nursing, physiotherapy, rehabilitation, psychological, nutritional or other regulated professional advice. It does not replace an examination, diagnosis, treatment plan, rehabilitation programme, prescription or advice from an appropriately qualified professional who knows your circumstances.
Your use of TENTAVA, communication with KITAV and use of AI or coaching features do not create a doctor-patient, therapist-patient or other healthcare professional relationship with KITAV. KITAV does not diagnose users or provide individual medical care through TENTAVA.
4. Consult a qualified healthcare professional
Consult an appropriately qualified healthcare professional before beginning, resuming or materially changing an exercise programme if you have any reason to doubt whether the activity is suitable for you. This is especially important if you:
- have a diagnosed or suspected cardiovascular, respiratory, neurological, metabolic, musculoskeletal or other medical condition;
- have pain, dizziness, fainting, unusual shortness of breath, palpitations or other unexplained symptoms;
- are injured, recovering from surgery or illness, or participating in rehabilitation;
- are pregnant, postpartum or planning exercise during a medically sensitive period;
- take medication or use a medical device that may affect exercise tolerance, heart rate, breathing, balance or recovery; or
- are aged 16 or 17, have a disability, are new to exercise or plan unusually intense, prolonged or hazardous activity.
Follow the instructions and restrictions given by your healthcare professional. Do not delay, disregard or discontinue professional medical advice because of information shown in TENTAVA.
5. Emergencies and warning symptoms
TENTAVA does not monitor you continuously, detect emergencies or contact emergency services. Notifications, messages, Live Activities, sensor displays, AI features and coach communications may be delayed, unavailable, incomplete or wrong.
Stop exercising and seek immediate professional help if you experience chest pain or pressure, fainting, severe or unusual shortness of breath, sudden weakness or numbness, confusion, loss of coordination, a severe allergic reaction, signs of heat illness, a serious injury or any other symptom that may indicate an emergency.
In an emergency, contact the emergency services for your current location immediately. Do not wait for a response from KITAV, another user, a coach or an AI feature, and do not use TENTAVA as your means of requesting emergency assistance.
6. Exercise risks and your safety responsibilities
Physical activity carries inherent risks, including overexertion, falls, collisions, dehydration, heat or cold illness, equipment failure, muscle or joint injury, cardiac events and, in rare cases, permanent injury or death. Risk varies with your health, conditioning, technique, intensity, environment and equipment.
You remain responsible for deciding whether, when and how to perform an activity. Use appropriate technique, progression, warm-up and recovery; inspect and use equipment correctly; choose safe surroundings; remain aware of traffic, weather, terrain and other people; obtain supervision where appropriate; and comply with facility, event and local safety rules.
Do not exercise while distracted by your device. Do not interact with TENTAVA where doing so would be unsafe, including while driving, cycling in traffic, operating equipment or performing a movement that requires your full attention.
7. Measurements, estimates and data limitations
TENTAVA may display or calculate values such as heart rate, respiratory rate, duration, distance, speed, pace, power, energy expenditure, training volume, intensity, recovery indicators, progress scores, predictions and trends. These values may be estimates and may be affected by sensor placement, device quality, algorithms, permissions, connectivity, manual entry, file quality, environmental conditions and other factors.
Data obtained from Apple HealthKit, Wahoo, Polar, Bluetooth heart-rate or respiratory-rate sensors, FIT files or another supported source may be delayed, duplicated, incomplete, incorrectly mapped or inaccurate. A consumer wearable or sensor is not necessarily a medical device, even when it reports a physiological value. Refer to the manufacturer’s instructions, intended use, warnings and regulatory status for each connected product.
Do not use TENTAVA values as the sole basis for a diagnosis, medication change, treatment decision, return-to-sport clearance or other medical decision. If a value appears abnormal, conflicts with how you feel or differs from professional testing, stop relying on it and obtain appropriate professional advice.
8. AI-supported features
AI-supported features may generate workouts, reviews, weekly summaries, suggestions or explanations from information available to the feature. AI output is probabilistic and may be inaccurate, incomplete, inconsistent, outdated, overly general or unsuitable for your health, experience, equipment or circumstances.
AI output is not medical advice, a clinical assessment, a personalised rehabilitation plan or a guarantee that an activity is safe. Review every AI output before acting on it. Reduce or reject any recommendation that appears excessive, unsafe or inconsistent with professional advice. Never use AI output for emergency, diagnostic, treatment or other high-risk medical decisions.
Separate consent for specified processing of health- and fitness-related data does not make the resulting AI output medically validated. Withholding or withdrawing that consent disables the affected AI functions as described in the Terms of Use and Privacy Policy.
9. Exercise library, plans and goals
Exercise descriptions, demonstrations, templates, generated sessions, suggested loads, repetitions, rest periods and progression information are general references. They cannot account for every anatomical difference, medical condition, injury, limitation, environment or equipment setup.
Goals relating to body weight, performance, frequency, sleep, recovery or other wellness measures are planning tools only. TENTAVA does not promise any health, fitness, weight, performance or appearance result. Progress is individual and may be affected by health, training history, adherence, recovery and other circumstances.
10. Coaches, athletes and other users
TENTAVA may enable users to identify themselves as coaches, communicate, share activities or record training for another user. KITAV does not employ those users, verify every identity or qualification, supervise their services, or endorse their instructions merely because they use TENTAVA.
A coach is independently responsible for acting within their qualifications and legal scope of practice, maintaining appropriate insurance and referring an athlete to a healthcare professional when needed. A coach must not use TENTAVA to provide a medical diagnosis or treatment unless separately authorised and qualified to do so under applicable law.
Athletes should independently assess advice, confirm a coach’s qualifications where relevant and stop an activity that causes concerning symptoms or appears unsafe. Messages, public workouts and user-generated content may be incorrect and are not statements or advice from KITAV.
11. Imported, public and third-party content
Third-party integrations, linked services, imported files, public activities, routes and content supplied by other users are controlled or created by their respective providers or users. KITAV cannot guarantee their accuracy, safety, availability or suitability.
Check imported workouts and routes before use. Public or shared content may omit hazards, access restrictions, required equipment or relevant health context. Never assume that a route, challenge, workout or exercise is safe merely because it appears in TENTAVA or has been completed by another person.
12. Records and continuity
TENTAVA is not designed to be the sole repository for medical records, clinical instructions or information needed for urgent care. Service interruptions, account restrictions, device loss, synchronisation errors or data deletion may prevent access. Keep any information needed for healthcare or safety through an appropriate independent system and provide relevant information directly to your healthcare professional.
13. No warranty of medical suitability
To the extent permitted by law, KITAV does not warrant that TENTAVA content, measurements, estimates, AI outputs, integrations or communications are medically accurate, clinically validated, complete or suitable for a particular person or purpose. No statement in TENTAVA should be interpreted as a medical claim unless KITAV expressly identifies it as such and provides the required regulatory information.
This section does not limit any express product commitment, statutory conformity right or warranty that cannot lawfully be excluded.
14. Liability and mandatory rights
The allocation and limitation of liability in the TENTAVA Terms of Use applies to use of TENTAVA, including health- and fitness-related use. Nothing in this Disclaimer excludes or limits liability for death or personal injury caused by negligence where such liability cannot lawfully be limited, fraud or fraudulent misrepresentation, defective products, gross negligence or intentional misconduct where applicable, or any other liability or mandatory consumer right that cannot legally be excluded or limited.
This Disclaimer does not transfer to you risks created by KITAV’s breach of a mandatory duty and does not reduce any remedy available under the mandatory law of your country or state of residence.
15. Changes to this Disclaimer
KITAV may update this Disclaimer to reflect changes in TENTAVA, safety information, technology, law or regulatory guidance. The current version and effective date will be available in TENTAVA and on tentava.app. Material changes will be notified where required by law. Changes do not retroactively reduce accrued rights or remedies.
