2.1 Provider, scope and acceptance

These Terms of Use govern access to and use of kitav.ch and www.kitav.ch, the company website operated by KITAV Vuong. By using the website, you agree to comply with these Terms. If you do not agree, do not use the website.

These Terms cover only the company website. Separate products, applications, purchases and third-party services may be governed by separate terms presented with the relevant service.

2.2 Informational purpose; no offer

The website provides general information about KITAV, its activities and ways to contact the company. Unless expressly stated otherwise, website content is not a binding offer, promise, warranty or contract. A contract is formed only through a separate, express agreement or purchase process.

You authorise KITAV to process and reproduce the submission only as reasonably necessary to receive, route, answer and document your request, comply with law and protect legal rights. KITAV does not control third-party content, availability, security, terms or privacy practices and is not responsible for them beyond liability imposed by mandatory law. To the maximum extent permitted by law, the website is provided 'as is' and 'as available'. KITAV does not make implied warranties that the website will meet every requirement, remain continuously available, be compatible with every device, or that every item of information will be complete, accurate or current. This clause does not exclude an express promise or a statutory guarantee that cannot lawfully be excluded.

2.9 Limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence, mandatory product liability, or mandatory consumer, data-protection or other statutory remedies.

KITAV is not responsible for harm caused by a third-party website or service outside its reasonable control.

2.10 Privacy and cookies

The Privacy Policy explains how KITAV processes personal data. The Cookie Settings describe necessary local storage and optional Analytics cookies and let you change or withdraw your choice at any time.

2.11 Changes to these Terms

KITAV may update these Terms to reflect changes to the website, law, security or business operations. The current version and effective date will be published on the website. Changes apply prospectively from the stated effective date and do not reduce rights or remedies that have already accrued.

2.12 Governing law and jurisdiction

These Terms are governed by substantive Swiss law, excluding conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of mandatory protection under the law of your habitual residence.

Courts at KITAV's registered place in Switzerland have jurisdiction where a valid choice of forum is permitted. Consumers remain entitled to any court or forum available under mandatory law. Before filing a claim, the parties are encouraged, but not required, to try to resolve the matter by contacting info@kitav.ch.

2.13 General provisions

If a provision is invalid or unenforceable, it will be enforced to the maximum lawful extent or severed, and the remaining provisions remain effective. Failure to enforce a provision is not a waiver. Headings are for convenience only. These Terms do not create rights for third parties unless mandatory law provides otherwise.
